Terms of Service

1. Acceptance of Terms

By accessing or using the HelloCrush platform (hereinafter, “the Service”), located at hellocrush.ai, you agree to be bound by these Terms of Service (“Terms”), as well as our Privacy Policy. If you do not agree with any of these Terms, you must refrain from using the Service.

These Terms constitute a legally binding agreement between you and SRE Capital Investments SAS, a commercial company incorporated and domiciled in the Republic of Colombia, identified with NIT 901733207, operator of the HelloCrush platform. Continued use of the Service after any modification implies your acceptance of the updated Terms.

2. Description of the Service

HelloCrush is an artificial intelligence (AI)-based digital companionship platform. The Service allows users to interact with virtual personas (hereinafter, “AI Companions”) through:

• Real-time text chat
• Synthesized voice notes and voice calls
• AI-generated images and videos
• Exclusive content unlocked through credits
• Virtual gift system

HelloCrush reserves the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without prior notice.

3. Age Requirements

The Service is intended exclusively for persons aged 18 years or older. By registering, you represent and warrant that you are at least 18 years of age. If HelloCrush becomes aware that a user is under 18 years of age, it will immediately suspend or delete their account.

The Service may include mature romantic and suggestive themes intended for adults. The Service does not offer sexually explicit content. HelloCrush is not responsible for access by minors to the Service when such access results from false information provided by the user during registration.

4. Registration and User Accounts

To access most features of the Service, you must create an account. You agree to:

• Provide truthful, accurate, and complete information during registration.
• Keep such information up to date.
• Maintain the confidentiality of your password and access credentials.
• Immediately notify HelloCrush of any unauthorized use of your account.
• Not share your account with third parties or allow others to use it.

You are solely responsible for all activities carried out from your account. HelloCrush shall not be liable for losses arising from unauthorized use of your account when such use results from your own failure to maintain reasonable security measures.

5. Subscription Plans and Payments

5.1 Subscription Plans

HelloCrush operates on a two-tier access model:

• FREE: Basic access with a limit of 20 daily messages per conversation, text and gifts only.
• Subscribed: Unlimited chat, voice notes, AI-generated photos and selfies, photo sharing in chat, and gifts. Exclusive content (additional photos, videos, and voice calls) available through credits.

Subscribed access is offered through the following monthly plans, which determine how many connections (characters) the user can subscribe to simultaneously:

• Single — USD $14.99/month: 1 connection.
• Duo — USD $24.99/month: up to 2 connections.
• Triple — USD $29.99/month: up to 3 connections.
• All Access — USD $39.99/month: all available connections.

All paid plans grant the same set of features per connection. Plans differ only in the number of connections included.

5.2 Credit System

Additionally, the Service offers a credit system that allows users to unlock exclusive content or send virtual gifts. Credits are purchased through one-time payments and do not expire as long as the account remains active.

5.3 Billing

Payments are securely processed by Stripe. Subscriptions are automatically renewed at the end of each billing period unless the user cancels before the renewal date. Prices are displayed in US dollars (USD) and include applicable taxes when required by Colombian law.

5.4 Refund Policy

In accordance with Ley 1480 de 2011 (Colombian Consumer Protection Statute), users residing in Colombia have the right to withdraw from purchases made through electronic means within five (5) business days following the transaction, provided that the digital content has not been downloaded or consumed. Credits already used are non-refundable. To request a refund, contact us at legal@hellocrush.ai.

6. AI-Generated Content

HelloCrush's AI Companions are fictional characters created using artificial intelligence. They are not real people, they do not possess consciousness, and their responses are automatically generated.

By using the Service, you acknowledge and agree that:

• AI Companions do not replace real human relationships or professional mental health care.
• Any statement, advice, or expression of feelings by AI Companions is AI-generated content and should not be interpreted as medical, psychological, financial, or legal advice.
• HelloCrush does not guarantee the accuracy, completeness, or suitability of the generated content.
• If you experience emotional or mental health difficulties, or thoughts of self-harm, we urge you to seek professional help or contact your local emergency services.

7. User Content

By uploading images, sending messages, or other content to the Service (“User Content”), you grant HelloCrush a worldwide, non-exclusive, royalty-free, and sublicensable license to use, reproduce, process, and display such content solely for the purpose of providing the Service.

You represent and warrant that:

• You are the owner or have the necessary licenses to share the User Content.
• The User Content does not infringe third-party rights or violate applicable law.
• You will not upload material that depicts minors in a sexually explicit manner or that violates child protection laws.

HelloCrush reserves the right to remove any User Content that violates these Terms or that it deems inappropriate, at its sole discretion.

8. User Conduct

The following are expressly prohibited:

• Using the Service for illegal activities or activities that infringe third-party rights.
• Attempting to gain unauthorized access to systems, accounts, or data of other users.
• Reverse-engineering, decompiling, or attempting to extract the source code of the Service.
• Using bots, scrapers, or other automated tools to access or extract data from the Service without written authorization.
• Harassing, threatening, or intimidating other users or HelloCrush personnel.
• Publishing, transmitting, or distributing content that is defamatory, obscene, abusive, or that promotes discrimination.
• Soliciting, attempting to generate, or uploading sexually explicit content or nudity, including depictions of sexual acts. The Service does not offer this type of content.
• Uploading files that contain viruses, malware, or other harmful code.
• Infringing the intellectual property rights of HelloCrush or third parties.
• Reselling or commercially exploiting the Service without express authorization.

Violation of these rules may result in the immediate suspension or cancellation of your account, without prejudice to any applicable legal actions.

9. Intellectual Property

All rights in the Service, including its design, source code, logos, trademarks, texts, graphics, images, and content generated by the AI Companions, are the property of HelloCrush or its licensors and are protected by Colombian and international intellectual property laws.

Nothing in these Terms grants you any rights over HelloCrush's intellectual property, except for the limited and personal right to use the Service in accordance with these Terms.

10. Limitation of Liability

To the maximum extent permitted by applicable Colombian law, HelloCrush shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of data, revenue, profits, or reputation.
• Service interruptions or errors in AI-generated content.
• Decisions made by the user based on content generated by the AI Companions.

HelloCrush's total liability for any claim arising from the use of the Service shall not exceed the amount paid by the user during the three (3) months preceding the event giving rise to the claim.

11. Termination of Service

HelloCrush may suspend or cancel your access to the Service, with or without prior notice and for any reason, including breach of these Terms. You may cancel your account at any time from the settings section of your profile or by contacting legal@hellocrush.ai.

Upon cancellation, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination (such as limitation of liability and intellectual property) shall remain in effect.

12. Modifications to the Terms

HelloCrush reserves the right to update these Terms at any time. When material changes are made, users will be notified by email or through a prominent notice on the Service. The date of the last update is indicated at the beginning of this document. Continued use of the Service after the publication of changes implies acceptance of the new Terms.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Colombia. Unless the mandatory laws of your jurisdiction provide otherwise, any dispute arising from or related to these Terms shall be submitted to the exclusive jurisdiction of the competent courts of the city of Bogota D.C., Colombia, without prejudice to consumer rights established under Ley 1480 de 2011 (Colombian Consumer Protection Statute).

14. Provisions for Users in the United States

14.1 Binding Arbitration

If you reside in the United States, any dispute, claim, or controversy arising from or related to these Terms or the use of the Service shall be resolved through binding individual arbitration, administered in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted online or in the county where you reside. You agree that the arbitration shall be individual and that you waive the right to participate in class actions or collective lawsuits.

14.2 Exceptions to Arbitration

Notwithstanding the foregoing, either party may bring claims in small claims court if the claim qualifies. Furthermore, nothing in this section prevents HelloCrush from seeking injunctive relief before competent courts to protect its intellectual property.

14.3 Governing Law (U.S.)

For users residing in the United States, these Terms shall be construed in accordance with applicable federal laws of the United States and the laws of the state of your residence, without regard to conflict of law rules.

15. Provisions for Users in the European Union

If you reside in the European Economic Area (EEA), the United Kingdom, or Switzerland:

• The mandatory consumer protection laws of your country of residence shall prevail over any conflicting provision in these Terms, in accordance with Directive 2011/83/EU on consumer rights.
• You have the right to resolve disputes through the European Commission's Online Dispute Resolution (ODR) platform, available at ec.europa.eu/consumers/odr.
• The processing of your personal data is additionally governed by the General Data Protection Regulation (EU) 2016/679 (GDPR). Please refer to our Privacy Policy for more details.
• You have a 14-calendar-day right of withdrawal from the date of subscription, unless you have consumed digital content during that period with your express consent.
